Terms of Service

By commissioning me, you are agreeing to the following terms and conditions:

 

GENERAL:

  • Terms of Service and Prices are subject to change at anytime. You are only subject to the ToS and prices agreed upon at the time of the transaction.

  •  I reserve the right to reject a commission for any reason. 

  • All artwork is transferred digitally. 

 

PAYMENT:

  • Payments will only be accepted through PayPal in USD. 

  • Customer agrees to pay a 50% deposit before I will start the commission. Once I accept your commission, I will send an invoice via PayPal, due in 10 days. Once the invoice is paid, I will start your commission. If the invoice is not paid, I will have to cancel the commission. 

  • Any other payment schedule has to be mutually agreed before work on the commission commences.

 

DEADLINES:

  • Depending on my workload, the turnaround time should take no longer than 2 weeks. I will provide an estimate time for completion, and/or indicate if there is a delay in completing your commission. You may request a WIP at any time.

 

REVISIONS:

  • Customer has the right to 5 complete revisions in the sketching phase.

  • Customer has the right to any color changes during the flat color phase. Once those are approved, color changes are locked in or Customer will be charged.

  • Customer has right to a reasonable amount of minor edits after completion, such as changing an eyecolour or fixing a small detail, up to an additional 10% of the total time spent on creating the originally delivered commission. Any requests above that, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.

  •  

USAGE POLICY:

  •  The commission product received by Customer is for personal use. 

  • Any use of the commission for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the commission- currently a 40% commercial license is required for anything outside of personal use.

  • Customer does not hold the right to use the commission in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.

  • In addition, Customer does not hold the right to use the commission product for AI datasets or for AI tools and any present or future inventions in the space. 

  • I reserve the right to my artwork and the right to post it; if you would like your commission to be private, please let me know!

 

PRODUCT DELIVERY:

  • Customer agrees that commission product will be delivered digitally to email address provided by Customer, after the final payment has been received by the Seller.

  • Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. Customer is obliged to bear any costs incurred by alternative delivery method, such as postal costs, material costs, digital service subscription fees etc.

 

  •  It is sole responsibility of Customer to propose delivery method which works for both parties. Seller cannot be held accountable for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Seller.

  • Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.

 

REFUNDS:

  • You may receive a full refund only if I have not started your commission. If I have started your commission, I will issue a partial refund based on how much work is done. If I cannot finish your commission for whatever reason, you will be refunded in full.

  •  No refunds will be issued once artwork has been completed.

 

CANCELLATIONS:

  • Seller reserves every right to refuse or cancel any order, under condition of full refund, without giving reasons to Customer.

  • Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. Customer will receive full or partial refund depending on amount of work completed. Seller will have full right to refuse any service to the Customer in the future.



 

No Generative AI Training Use: 

  • For avoidance of doubt, Licensor reserves the rights, and Licensee has no rights to, reproduce and/or otherwise use the Property in any manner for purposes of training artificial intelligence or machine learning technologies to generate images, including without limitation, technologies that are capable of generating images in the same style or genre as the Property. Nor does Licensee have the right to sublicense others to reproduce and/or otherwise use the Property in any manner, including for purposes of training artificial intelligence or machine learning technologies to generate images.
